Wage & Hour Rights and Responsibilities

Wage Payment: Employee rights consist of:- Pay for all earnings earned (INFO # 3) at the rate agreed to by the employer and employee.

– Pay of a minimum of base pay (INFO # 1), the relevant Colorado or employment local minimum wage, and all earned overtime wages without impermissible deductions from their salaries;.

– Pay of all earned earnings without impermissible deductions (INFO # 16).

Labor Statutes, Rules, & Published Guidance

Statutes & Rules: DLSS imposes much of Colorado’s wage and hour and other types of labor statutes and labor guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (” COMPS Order”), and the Equal Pay for Equal Work Act. Please go to the Division’s Labor Statutes and Labor Rules websites for existing and previous versions of crucial Colorado labor statutes and rules.

Published Guidance: The Division’s primary types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) – the Division’s formally authorized notices, viewpoints, and descriptions on various labor law topics; and.

– KNOWLEDGEs (Knowledge for Workers on Labor employment Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.

Written Demands, Complaints, & Investigations

Demands & Complaints for Wages: If an employer owes you wages, you can send your company a written need for payment of incomes by mail, e-mail, text, or other electronic means. A written need may be sent out to the company at the very same time a Labor Standards Complaint Form for unpaid incomes is submitted with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, employment Responses, and Settlements webpage.

Employer Responses in Investigations: Once a total Labor Standards Complaint Form is received and examined, a letter describing the nature of the grievance and the amounts declared to be owed is sent to the company. To learn more about the investigation procedure, please examine the Wage & Hour Claim Investigations – Employer FAQs website.

Investigations Launched by the Division (” Direct Investigations”): The Division might conduct employer-wide direct investigations of potential violations of Colorado wage and hour law. If you wish to send a suggestion, please email the Division at cdle_di_tips@state.co.us. If you would like to submit a private claim for overdue incomes, you must complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct investigation citation or several Notices of Assessment, an alleged employer may send a Direct Investigation Appeal Form.
